REQUEST FOR WAIVER OF PEC REGISTRATION REQUIREMENT FOR SUPPLY OF LIQUID OXYGEN

Respected Sir,
With due respect, we would like to request your kind waiver of the Technical Specifications and Requirements (Annex A-1) clause No 07 incorporated in the bidding documents:
“Bidder must be registered in PEC in category ___________ failing which the offer will be liable to rejection. PEC registration certificate must be part of the technical bid.”
We respectfully submit that our company is participating solely for the supply of Liquid Oxygen, which is a manufactured chemical product produced through an Air Separation Unit (ASU). As per the United Nations International Standard Industrial Classification (ISIC Rev.4), Class 2011 – Manufacture of Basic Chemicals, the production of liquefied and compressed industrial/medical gases, including Liquid Oxygen, falls under the Chemical Manufacturing Industry.
Furthermore, the operation of an Air Separation Unit (ASU) requires the supervision of qualified Chemical Engineers. Our manufacturing facility is operated by duly qualified Chemical Engineers, and we can provide their Pakistan Engineering Council (PEC) registration cards as evidence of technical competency, if required by the procuring agency.However, the requirement for the manufacturing firm itself to hold PEC registration is not applicable where the scope of procurement is limited to the supply of Liquid Oxygen and does not include engineering services, construction, or consultancy services. We respectfully request you to waive the PEC registration.
